These Terms of Service (“Terms”) govern your access to and use of My Rental Marketplace (the “Platform”), including any content, functionality, and services offered (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Services.

1. The Platform

My Rental Marketplace is a peer-to-peer marketplace that enables users to list items for rent (“Sellers” or “Owners”) and users to rent items (“Renters”). We provide the platform and payment flow, but we are not a party to the rental agreement between Owners and Renters unless stated otherwise.

2. Eligibility and Accounts

  • You must be at least 18 years old to use the Services.
  • You agree to provide accurate, current information and to keep your account information updated.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. Listings and Rentals

A. Owner Responsibilities

Owners agree that all listings and item descriptions will be accurate, lawful, and not misleading. Owners are responsible for:

  • Item availability and condition
  • Clear rental terms communicated through the platform
  • Providing items that are safe, functional, and compliant with applicable laws
  • Honoring confirmed bookings (except where cancellation is permitted)

B. Renter Responsibilities

Renters agree to use rented items safely and lawfully and to return items on time and in the condition received (reasonable wear and tear excepted). Renters are responsible for:

  • Reviewing listing details before booking
  • Any damage, loss, or late returns as defined by platform rules and/or agreements with the Owner
  • Using items according to manufacturer instructions and safety guidelines

4. Payments, Fees, and Taxes

Payments are processed through third-party payment providers (for example, Stripe). By using the payment features, you agree to the payment provider’s terms and policies.

  • Platform fees (if any) will be displayed during checkout or otherwise communicated.
  • Owners are responsible for determining and complying with any tax obligations associated with their rentals.
  • We may withhold payouts or refunds where fraud, disputes, or policy violations are suspected.

5. Cancellations, Refunds, and Disputes

Cancellation and refund rules may be displayed in the listing, during checkout, or within the Platform policies. In the event of a dispute (damage, late return, non-delivery, etc.), users agree to cooperate with our support process and provide requested documentation.

We may (but are not required to) assist with dispute resolution. Final responsibility for the rental agreement remains between the Owner and the Renter unless otherwise stated.

6. Prohibited Conduct

You agree not to:

  • Post unlawful, harmful, misleading, or fraudulent content
  • List prohibited or restricted items where illegal or unsafe
  • Harass, threaten, or abuse others
  • Attempt to bypass platform payments or fees
  • Interfere with the Services, security, or proper functioning of the Platform
  • Reverse engineer, scrape, or exploit the Services except as permitted by law

7. Content and Intellectual Property

You retain ownership of the content you post, but you grant My Rental Marketplace a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for operating and promoting the Services.

All platform software, branding, and site design are owned by My Rental Marketplace or its licensors and are protected by applicable intellectual property laws.

8. Safety and Risk

Renting items involves risk. You agree that you use the Services at your own risk. Owners and Renters are responsible for evaluating item suitability and safety. We do not guarantee the condition, legality, or safety of any item listed.

9. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, My Rental Marketplace disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, My Rental Marketplace and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from or related to your use of the Services.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid to us (if any) in the 3 months preceding the claim, or (b) $100.

11. Indemnification

You agree to defend, indemnify, and hold harmless My Rental Marketplace from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Services, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your account or access to the Services at any time for violations of these Terms, suspected fraud, security risks, or other lawful reasons. You may stop using the Services at any time.

13. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on this page and revise the effective date above. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Maine and applicable United States federal law, without regard to conflict of law principles.
